1. Acceptance of Terms

By downloading, installing, or using the Wabisa app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Age Requirements

Wabisa is rated 4+ and is suitable for users of all ages. Users under the age of 13 should use the app under parental supervision. By using the app, you confirm that you meet the age requirements set by the Apple App Store or Google Play Store in your region, or that you have obtained appropriate parental consent.

3. Use of the App

The Wabisa app is provided for personal, non-commercial language learning purposes. You agree to:

Use the app only for its intended purpose of learning Japanese
Not attempt to reverse engineer, modify, or distribute the app
Not use the app in any way that could damage or impair the service

4. AI Practice Mode — Acceptable Use

The AI conversation practice feature is provided exclusively as a tool for practising spoken Japanese. By using Practice Mode, you agree to:

Use the AI tutor solely for Japanese language learning and practice
Not attempt to use the AI tutor for any purpose outside of language learning
Not submit content that is offensive, abusive, hateful, sexually explicit (NSFW), or otherwise inappropriate
Not attempt to manipulate or jailbreak the AI system
Not use the AI tutor to generate or distribute harmful, unlawful, or misleading content

We reserve the right to suspend or terminate access to Practice Mode for any user who violates this acceptable use policy, without notice or refund.

5. AI Features Disclaimer

The app includes AI-powered conversation practice. AI responses are generated dynamically and may occasionally contain errors. The AI tutor is a learning tool and should not be considered a definitive authority on the Japanese language.

6. Intellectual Property

All content in the Wabisa app, including lessons, audio recordings, curriculum design, and assessments, is the intellectual property of Wabisa and is protected by copyright law.

7. Purchases and Refunds

All purchases made through Wabisa — including the one-time Learn unlock and the Learn + Practice monthly subscription — are processed exclusively through the Apple App Store or the Google Play Store, depending on your platform.

Apple App Store purchases: Refunds are subject to Apple's refund policy. Please visit Apple's refund page to request a refund.
Google Play Store purchases: Refunds are subject to Google Play's refund policy. Please visit Google Play's refund page to request a refund.
Subscription cancellation: You may cancel your Learn + Practice subscription at any time through the App Store or Google Play. Cancellation takes effect at the end of the current billing period.

Wabisa does not process payments directly and is unable to issue refunds. All billing enquiries must be directed to Apple or Google as applicable.

8. Disclaimer of Warranties

The app is provided "as is" without warranty of any kind. We do not guarantee that the app will be error-free or uninterrupted. Your use of the app is at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless Wabisa and its operators, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms of Service or your use of the app, including but not limited to your use of the AI Practice Mode in a manner inconsistent with these terms, any content you submit through the app, or your violation of any third-party rights.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Wabisa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use or inability to use the app.

11. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Japan.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will update the "Last updated" date when we do. Continued use of the app after changes constitutes acceptance of the updated terms.
